1. About these Terms
These Terms and Conditions govern the use of NJH Institute websites, portals and services, including course enrolments, learning content, memberships, employer services, assessments and professional certifications. The contracting entity is NoraJiks (Pty) Ltd trading as NJH Institute, company registration number 2017/045035/07, referred to as “NJH Institute”, “we”, “us” or “our”.
By creating an account, placing an order, enrolling, applying for membership or certification, or using a service, you agree to these Terms and the policies referred to in them. If you act for an organisation, you confirm that you have authority to bind it. Mandatory rights under South African law are not excluded.
2. Accounts and eligibility
You must provide accurate, current and complete information, keep login details confidential, and promptly update changes. You are responsible for activity under your account unless you notify us of suspected unauthorised use. An account is personal and may not be shared.
Where a service has stated entry, age, qualification, experience, document or CPD requirements, acceptance remains subject to verification. We may request evidence and reject, suspend or revoke an application or award obtained through false, incomplete or misleading information, subject to a fair process.
3. Course enrolment and delivery
A course order is accepted when we issue confirmation or grant access. Course descriptions, delivery mode, duration, entry requirements and fees shown at purchase form part of the order. Access periods run from the stated activation date unless otherwise agreed in writing.
You must complete your own work, observe assessment rules, respect facilitators and other learners, and use content only for personal learning. Course schedules, facilitators and reasonable components may change where necessary without materially reducing the service. If a material change prevents delivery, the remedies in the Refund and Cancellation Policy apply.
Completion, attendance or assessment does not guarantee employment, promotion, registration with a third party, or an external accreditation outcome. Any accreditation or recognition applies only where expressly identified in writing.
4. Memberships
Membership categories, fees, duration, minimum requirements, renewal rules and benefits are those published or quoted when an application is made. Membership starts only after required checks, approval and payment. Benefits are personal or organisational according to the category and may not be transferred.
Employer Verification Membership permits an approved employer to request verification of existing employee memberships and, only with the employee’s recorded consent and an authenticated link, view the CPD and membership information authorised for that employment relationship. It does not by itself permit inviting new applicants or paying their membership costs.
Corporate Sponsored Membership permits an approved employer to invite employees or applicants, link sponsored memberships and cover agreed employee costs. Corporate charges may include a fixed annual fee plus employee fees adjusted by the active employee-count pricing band. Employee consent and separate permissions remain required for access to detailed CPD records, testimonials or other optional disclosures.
An employer relationship does not transfer ownership of an individual’s account or records to the employer. We may remove access when consent is withdrawn, employment ends, the organisational membership lapses, or misuse is suspected. Actions may be audit logged.
5. Assessments and certifications
Assessment submissions must be original and comply with published rules. We may use plagiarism, identity or integrity checks and may investigate irregularities. Results may be reviewed through the stated appeal process.
Certificates and professional certifications are issued only after all requirements are met. They may carry an expiry or renewal requirement. We may suspend or revoke a credential for fraud, material error, breach of professional requirements or failure to maintain it, after notice and a reasonable opportunity to respond where appropriate.
6. Fees, payments and renewals
All prices are in South African rand and include or exclude VAT as stated. You must pay by an offered payment method. Third-party payment providers process payment credentials under their own terms; we ordinarily retain transaction references and payment status, not full card details.
Recurring or annual services renew only as disclosed at purchase or in a renewal notice. You must cancel before the renewal date to prevent the next charge where automatic renewal is enabled. We may suspend access for overdue amounts after reasonable notice. Refunds are governed by the Refund and Cancellation Policy and applicable law.
7. Intellectual property and permitted use
The platform, learning materials, assessments, branding, databases and related content belong to us or our licensors. We grant a limited, revocable, non-transferable right to access purchased services for their intended purpose during the access period.
You may not copy, sell, publish, scrape, record, distribute, reverse engineer, remove notices from, or give others access to protected content except where expressly permitted in writing or allowed by law. You retain rights in content you submit, while granting us the limited rights needed to deliver, assess, store and administer the service.
8. Acceptable use
You may not compromise security, impersonate another person, upload unlawful or malicious material, harass users, manipulate records, interfere with the platform, or use information obtained through employer or administrative access for an unauthorised purpose. We may restrict or suspend access while investigating a credible risk and will act proportionately.
9. Privacy and communications
We process personal information as described in the Privacy Policy. Service and account communications are necessary to administer the relationship. Marketing communications are optional and may be unsubscribed from at any time without affecting essential notices.
10. Availability, warranties and liability
We aim to provide services with reasonable care and skill but cannot promise uninterrupted internet access or compatibility with every device. Scheduled maintenance and events beyond reasonable control may affect availability.
Nothing in these Terms excludes liability or remedies that may not lawfully be excluded. To the extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable. Our aggregate liability arising from a particular paid service will ordinarily not exceed the amount paid for that service in the preceding 12 months, except where such a limit is prohibited by law, or for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence.
11. Suspension and termination
You may stop using the services at any time, subject to outstanding charges and the Refund and Cancellation Policy. We may suspend or terminate access for material breach, fraud, unlawful conduct, non-payment or serious security risk. Where reasonably possible, we will give notice and an opportunity to remedy. Provisions intended to survive termination, including payment, intellectual property, privacy, evidence and dispute provisions, remain effective.
12. Complaints and disputes
Raise a complaint at admin@njholdings.co.za with your name, reference number and requested resolution. We will acknowledge it and aim to respond within 10 business days. If unresolved, the parties should first attempt good-faith negotiation. You retain the right to approach an applicable regulator, ombud, tribunal or court, including the National Consumer Commission where relevant.
13. General
South African law governs these Terms. If a provision is invalid, it will be limited or removed without affecting the remainder. A failure to enforce a right is not a waiver. We may update these Terms for legal, security or operational reasons and will publish the effective date and give reasonable notice of material changes affecting an active paid service.
